Please read these Terms of Service carefully before accessing or using our website. By accessing or placing an order on Wizard's Fyre Games (the "Store"), you agree to be bound by these Terms of Service ("Terms") and all policies referenced here, including our Refund Policy and Privacy Policy. If you do not agree, do not use the Store.

The Store is operated by 2290172 ONTARIO INC. o/a Wizard's Fyre Games ("we", "us", "our"). You can reach us at [email protected]. Our website is hosted by SortSwift and Stripe. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

You must be at least the age of majority in your place of residence, or have the consent of a parent or legal guardian, to use this Store and to make a purchase.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

• Product descriptions, images, condition grades, and prices are provided for convenience and may contain errors. We reserve the right to correct errors and to cancel or refuse any order.
• All prices are listed in Canadian (CAD) unless stated otherwise and are subject to applicable taxes and shipping fees shown at checkout.
• Inventory is limited and items may sell out. We may limit quantities per customer or per order.
• We are not responsible if information made available on this site is not accurate, complete or current.

Submitting an order is an offer to purchase. We may accept or decline your order for any lawful reason. Payment is processed by our third-party payment processor; by paying you authorize the charge for the total shown at checkout, including taxes and shipping.

Currently we ship anywhere within Canada. We offer flat rate shipping calculated based on order subtotal at checkout. Parcels are shipped with either Canada Post or UPS at our discretion. Estimated shipping times are not guaranteed. Risk of loss passes to you upon delivery to the carrier. We are not responsible for carrier delays. Wizard's Fyre Games is not liable for Stolen or Misplaced or Lost in Transit orders that have been marked as delivered.

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

Gift cards bought on the Store are issued by Wizard's Fyre Games and may be redeemed only for products sold by us. They are not a bank product, carry no interest, and are not reloadable unless we say otherwise at the time of purchase.

• Gift cards do not expire and we do not charge dormancy, inactivity, or service fees against a balance.
• A gift card is redeemed against the order total at checkout. If the balance does not cover the order, the remainder is payable by another method; if it exceeds the order, the unused balance stays on the card.
• Gift cards are not returnable or refundable for cash, except where Ontario, Canada law requires us to cash out a balance at or below a set amount.
• Treat a gift card like cash. We are not able to replace a card whose code has been lost, shared, or used without your permission.
• Gift cards may not be resold, and we may void a card obtained fraudulently or through a payment that is later reversed.

• You agree not to use the Store for any unlawful purpose or in any way that could damage, disable, or impair it.
• You may not attempt to gain unauthorized access to any part of the Store, other accounts, or connected systems.
• You are responsible for keeping your account credentials confidential and for all activity under your account.
• We reserve the right to refuse Service to anyone for any reason at any time.

All content on the Store — including text, graphics, logos, and the Wizard's Fyre Games name — is owned by us or our licensors and is protected by applicable intellectual-property laws. Product names, card images, and trademarks remain the property of their respective rights holders.

Your submission of personal information through the store is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Occasionally there may be information on our Site or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

The Store and all products are provided "as is" and "as available" to the fullest extent permitted by law. To the maximum extent permitted by Ontario, Canada law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts located in Ontario, Canada, unless mandatory consumer-protection law provides otherwise.

You agree to indemnify, defend and hold harmless Wizard's Fyre Games and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

If any part of this Terms of Service agreement is found to be invalid or unenforceable, the remainder of the agreement remains effective and binding.

We may update these Terms from time to time. You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Continued use of the Store after changes take effect constitutes acceptance of the revised Terms.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
